Columbia, SC—Today, 39 members of the South Carolina Legislature sent President Donald Trump and the South Carolina Federal delegation a letter opposing federal “red flag” proposals.
Red Flag laws, otherwise known as Extreme Risk Protection Orders, allow judges to issue ex-parte gun confiscation orders, which may be based on an individual’s testimony. The accused would not have a chance to defend themselves against the allegations prior to the order being executed.
This process strips citizens of their 2nd, 4th, 5th, 6th, 9th, and 10th Amendment Rights. Instead, those accused are presumed guilty. Proving their innocence against these allegations can come at great personal expense in terms of time and money.
Representatives Jonathon Hill (District 8, R-Anderson), Stewart Jones (District 14, R-Laurens), Ashley Trantham (District 28, R-Greenville), and Josiah Magnuson (District 38, R-Campobello) wrote the letter in response to the President’s and Senator Lindsey Graham’s recent support of Red Flag laws.
Hill said, “In light of the recent tragedies, anti-gun groups have been howling for politicians at every level to do something. There is a dangerous belief that more gun laws, such as due process shredding Red Flag laws, will protect individuals. The simple truth is anti-gun laws do not protect people. If lawmakers want to decrease these tragedies passing Constitutional Carry and eliminating so-called ‘gun free zones’ would go a long way.”
Jones said, “The Founding Fathers warned us to never trade liberty for security, but that’s exactly what’s happening now. These proposed laws would leave law-abiding citizens defenseless against murderers and reverse the concept of ‘innocent until proven guilty.’ What we need is for lawmakers to do the right thing: more freedom for law-abiding people, and a total elimination of unconstitutional gun-free zones.”
